Non-resident capital gains tax

UK expats and other non-UK residents are, generally, not liable to UK capital gains tax (CGT), even on disposals of assets situated in the UK. However, there are some exceptions to this general rule, for example in the case of disposals by individuals who are temporarily non-UK resident.

In addition, UK CGT is due on the disposal of UK residential property by non-residents but generally only on any increase in the market value since 5 April 2015.

Even if there is no tax to pay on such a sale, the disposal needs to be reported to HMRC within 30 days of completion in order to avoid significant penalties arising.

We would be delighted to advise on how tax could be saved on any such sale and to prepare the necessary forms on your behalf so please get in touch if you have sold a residential property or are contemplating such a transaction.
